„Legea insolvenţei simplilor particulari era necesară, dar pentru a fi funcţională şi echitabilă, va trebui esenţialmente modificată. E o lege populistă, făcută ca o ambiţie personală a iniţiatorului său, când ar fi trebuit să fie o lege a sincerităţii, a transparenţei şi a celei de-a doua şanse. În acest domeniu, este deplin valabil „principiul” după care o lege proastă e mai bună decât nicio lege”. Gheorghe Piperea, interviu acordat Wolters Kluwer, în data de 14 august 2015.

]]>Care este componenta panelului de dezbatere?
In acest an, panelul de dezbatere va aduce laolalta mediatori profesionisti din cadrul U.C.M.R. preocupati de viitorul profesiei, precum si invitati-reprezentanti ai unor domenii relevante pentru mediatori, pentru a pune fata în fata perspectiva societatii asupra medierii cu aceea a profesionistilor din domeniu.
Intrebarea-cheie a dezbaterii este Poate medierea să fie un brand pentru România?, accentul fiind pus pe ariile de intersectie pe orizontala cu celelalte domenii reprezentate de invitatii nostri si a zonelor de aplicabilitate a medierii in variatele zone sociale reprezentate.
Vom porni de la faptul ca Romania a devenit recent un reper al mediatorilor de pace din intreaga lume, in aprilie 2015 fiind organizat la Bucuresti Congresul Anual al Mediators Beyond Borders (S.U.A.), in parteneriat cu Asociatia Mediatorilor S.T.A.R.S. Romania (afiliata U.C.M.R.).
In cadrul dezbaterii aflate pe agenda evenimentului din acest an, mediatorii din U.C.M.R. si invitatii lor vor cauta sa determine unde se situeaza medierea in acest moment si care sunt perspectivele ei de expansiune, ca activitate utila social, in viitor, pornind de la valentele ultimelor schimbari din interiorul profesiei noastre, si anume: organizarea profesiei la nivelul fiecarui judet prin infiintarea Corpurilor de Mediere Judetene, pentru organizarea si apararea drepturilor mediatorilor in mod eficient, precum si pentru garantarea dreptului de acces al fiecarui cetatean la o solutie mai facila, mai rapida si mai convenabila de solutionare a oricaror dispute sau litigii.
Vom aborda problema pacii sociale din perspectiva medierii; a utilitatii medierii pentru publicul larg; a cunoasterii si intelegerii conceptului de mediere si a receptivitatii publicului fata de aceasta metoda consensuala de solutionare a disputelor; a constientizarii rolulul mediatorilor de a creste capacitatea interna de raspuns pasnic la conflict a grupurilor si comunitatilor locale. Vom urmari pozitionarea medierii in contextul actual si al reprezentativitatii nationale, prin abordarea temei centrale. Poate Romania sa fie recunoscuta pentru mai mult decat ape, munti si traditii? Este societatea noastra capabila sa dea un exemplu prin promovarea medierii? Poate medierea, reprezentata prin specialistii din panel, sa se ridice la un standard demn de a fi un exemplu international? Opiniile invitatilor se vor alatura cunostintelor din interior ale specialistilor, pentru a da o directie posibila eforturilor U.C.M.R. pentru anul ce urmeaza.

In a treia parte a Congresului, care va avea loc sambata 24 Mai 2014 intre orele 14:30 – 17:00, federatia isi va alege organele de conducere pentru urmatorii doi ani, stabilind strategia de activitate. Uniunea Centrelor de Mediere din Romania (U.C.M.R.) isi propune sa continue misiunea asumata public pana in prezent, de a se implica activ in societatea civila si considera ca, in acest moment, este necesar sa devina un jucator important in mecanismul social si public din Romania.

Avem plăcerea de a vă aduce la cunoştinţă că, în data de 29 mai 2014, începând cu ora 09,30, în Aula Institutului Naţional al Magistraturii, va avea loc evenimentul de lansare a proiectului “Asistenţă pentru consolidarea capacităţii sistemului judiciar din România de a face faţă noilor provocări legislative şi instituţionale /Strengthening the capacity of the Romanian judicial system to face new legislative and institutional challenges”, implementat de Consiliul Superior al Magistraturii, în colaborare cu Ministerul Justiţiei, în cadrul Mecanismului Financiar Norvegian 2009-204.
Lansarea oficială a proiectului va avea loc în cadrul primei conferinţe, “Medierea pentru judecători şi procurori”, 29-30 mai 2014, organizată de Consiliul Superior al Magistraturii in cadrul Output-ului 2.5 al proiectului, la eveniment urmând să participe reprezentanţii instituţiilor partenere, Ministerului Justiţiei, judecători, procurori şi mediatori.

‘Lack of coherence in promoting mediation for civil and commercial disputes: the Italian case’
For about two yers (2010-2012), mandatory mediation has existed in Italy. The reactions arised, the mistakes made, the misinformation given and the successes obtained offer interesting insights on how to promote mediation in a concrete way, so testing “in the field” the suggestions given by the Council of Europe. The way in which Italian law was finally transformed, ending that experiment, brings to reflect if there is a lobby against mediation. Is an Ec directive sufficient to develop mediation in the continent or more concrete action is required?

Accordingly to U.N. Guidelines, “Effective mediation requires a supportive external environment … The actions of other States can help to reinforce a mediated solution or detract from it … a mediator must be accepted, credible and well supported (p.5) … However, support from civil society and other stakeholders cannot be taken for granted, as some of these actors may have hard-line positions and oppose the mediation (p.11)”.

She convinced the largest UK Government backed tenancy deposit scheme to run a mediation pilot alongside their adjudication scheme, the pilot has already demonstrated faster dispute resolution, reduction in complaints, higher customer satisfaction and significant cost savings for the not for profit organisation. Her proposal to the largest UK law firm franchise was accepted and the launch for a joint small claims service is expected January 2014. Whilst sounding like a cliche, Jo has the kind of passion and determination that will ensure she continues to bring small claims under the spotlight, and as a result reduces the burden on the courts that the high volume of these disputes creates.

Lorraine Schaffer, LL.M. was the Director of the Centre for Mediation and Conflict Resolution at the Institute of Family Therapy in London from July 2001 to August 2010 and Chair of a Postgraduate programme of courses in Conflict Resolution and Mediation studies at Birkbeck College, University of London. Lorraine was a practising family mediator for 15 years, beginning as a trainee at Eye to Eye in South London in 1995. Before that she worked as a social worker with adolescents and families, taught on the Brunel social work course and also specialised in social group work. Lorraine co-taught the family mediation module on the LLM at Westminster School of Law for several years. She was a group presenter for the mediation information meetings pilot for the Family Law Act and was an elected Governor of the UK College of Family Mediators for six years.

Still all about the process or is theory important? Is mediation a profession in its own right?
Mediation and dispute resolution processes in all realms require skilled interventions. Conflicts vary in intensity, but are by nature complex and if left unaddressed, the consequences can be very serious. I contend that we have a duty to consider the training and support mediators and other CR practitioners receive, if they are to meet these challenges. It takes between 2- 6 years to train in most professions; is it acceptable that in the UK and many other countries people can be trained as mediators in as few as 5 days?
Relevance to Conference:
Although my field of practice was family mediation, when teaching the postgraduate programme at Birkbeck College we included lectures on international conflict resolution, community, educational, and other forms of mediation as well as a broad range of theories of conflict and approaches to managing conflict. I think that the issue of whether theory is taught in all areas of mediation practice is relevant to the themes of this conference. Unless we have a more unified and coherent body of knowledge underpinning mediation training I do not believe we can be seen or trusted as professionals in our own right; until mediators and conflict specialists in all areas join together in promoting mediation to the public, we will not achieve our potential in addressing conflicts experienced by individuals, couples, families, workplaces as well as the prevention and management of conflicts facing international communities.
